Ohio Prenuptial Agreement

This Prenuptial Agreement (hereinafter referred to as "Agreement") is made on this ____ day of __________, 20__, by and between _________________________ (hereinafter referred to as "First Party") and _________________________ (hereinafter referred to as "Second Party") (collectively referred to as "Parties").

WHEREAS, the Parties intend to marry under the laws of the State of Ohio and wish to establish their respective rights and responsibilities regarding each other's assets and debts; and

WHEREAS, the Parties recognize the rights afforded to them under the laws of Ohio, including but not limited to, the Ohio Uniform Premarital Agreement Act (Ohio Revised Code Chapter 3105);

NOW, THEREFORE, in consideration of the forthcoming marriage, and other valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties agree as follows:

  1. Disclosure of Assets and Liabilities. Each Party has fully and accurately disclosed to the other Party all assets and liabilities that they currently hold, as detailed in Exhibits A and B attached hereto.
  2. Property Rights. The Parties hereby declare the following regarding their property rights:
    • Each Party's premarital assets shall remain their separate property.
    • All property acquired jointly after the marriage shall be considered marital property.
    • Each Party waives their right to claim against the other's premarital property in the event of separation, divorce, or death.
  3. Spousal Support. The Parties agree that in the event of a separation or divorce, the terms of spousal support (if any) will be determined as follows:
    • Any spousal support agreements must be in writing and agreed by both Parties.
    • Consideration will be given to the duration of the marriage, the standard of living established during the marriage, and the financial resources of each Party.
  4. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law provisions.
  5. Modifications and Amendments. No modification or amendment to this Agreement shall be valid unless made in writing and signed by both Parties.
  6. Severability. If any part of this Agreement is held to be invalid or unenforceable, that part will be severed from this Agreement, and the remaining provisions will continue to be valid and enforceable.
  7. Entire Agreement. This Agreement, including all exhibits attached hereto, constitutes the entire agreement between the Parties pertaining to the subject matter hereof and supersedes all prior agreements, representations, and understandings of the Parties.
