Submitting a DMCA Takedown Notice

To file a DMCA Takedown Notice, it is necessary to provide a written communication that includes the following elements:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
  • Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Response to a DMCA Notice

Upon receipt of a compliant DMCA Takedown Notice, Ohio PDF Forms will promptly:

  • Evaluate the notice to ensure it meets all legal requirements.
  • Remove or disable access to the infringing material.
  • Make a good faith attempt to contact the content provider, member, or user responsible for the infringing material to inform them of the removal.

It is our policy to document all notices of alleged infringement upon which we act. A copy of the notice may be sent to a third-party which may make it public. By submitting a DMCA Notice, the complaining party accepts that the information provided in the notice may be shared accordingly.

Counter Notification

In the event that the content provider, member, or user believes that the content that was removed or to which access was disabled was not infringing, or the content provider, member, or user believes that they have the right to post and use such material from the copyright owner, the copyright owner's agent, or pursuant to the law, they may submit a counter-notification. This counter-notification must contain the following:

  • A physical or electronic signature of the content provider, member, or user.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that the content provider, member, or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact information of the content provider, member, or user, such as an address, telephone number, and, if available, an electronic mail address.
  • A statement that the content provider, member, or user consents to the jurisdiction of the Federal Court for the judicial district in which the address is located, or if the content provider, member, or user's address is outside of the United States, for any judicial district in which the service provider may be found, and that the content provider, member, or user will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.

Upon receipt of a valid counter-notification, Ohio PDF Forms will follow the appropriate legal steps to resolve the issue, which may include notifying the original complaining party and restoring the content in question, unless further legal action is initiated against the content provider, member, or user.
